Terms of Service
1. Operator and acceptance of these Terms
MarginNav is provided by Dudás Digital Studio, a Swiss sole proprietorship based in Lugano, Switzerland. Full company details are available in our Legal Notice. By creating a MarginNav account or subscribing to the service, you agree to these Terms of Service and acknowledge our Privacy Policy.
2. What MarginNav provides
MarginNav is restaurant financial decision-support software. Based on the menu, ingredients, recipes and daily sales figures you enter, MarginNav calculates and displays dish-level information such as revenue, food cost, and gross profit or margin. MarginNav is not accounting, bookkeeping, tax, point-of-sale, inventory-management software, or a legal or financial advisory service, and does not replace professional financial, tax or legal advice.
3. Your account and responsibilities
MarginNav is designed for business use by independent restaurants and hospitality businesses. By using MarginNav, you confirm that you are using it for such business or professional purposes. You are responsible for keeping your account credentials confidential and for activity under your account. MarginNav supports different roles within a restaurant account, such as owner, manager and staff, with different levels of access.
4. Your data and recipes
The restaurant data you enter into MarginNav — including your menu, ingredients, ingredient prices, recipes and sales figures — remains yours. You grant MarginNav only the limited permission needed to host, process and display this data in order to provide the service to you. MarginNav's software, design and underlying technology belong to Dudás Digital Studio and are not transferred to you by using the service. Details on exporting your data or requesting account deletion are set out in our Privacy Policy.
5. Subscription, trial and billing
MarginNav offers a 7-day free trial. A valid payment method is required at checkout, but nothing is charged during the trial period. If automatic renewal remains on, the trial converts automatically into your selected paid subscription at the end of the 7-day trial. Paid subscriptions are available monthly (CHF 19 or EUR 19 per month, depending on your location) or annually (CHF 190 or EUR 190 per year — equivalent to two months free compared with paying monthly). Subscription payments are processed by Stripe.
6. Automatic renewal and ending your subscription
Subscriptions renew automatically for successive monthly or annual periods unless automatic renewal is switched off before the applicable renewal or trial-end date. You can switch automatic renewal on or off at any time from Account → Subscription. Turning automatic renewal off does not cancel your subscription immediately: you retain access for the rest of the period you have already paid for (or, during your free trial, until the trial ends), and no further charge occurs. If you change your mind, you can switch automatic renewal back on at any time before the subscription actually ends.
7. Refunds
Fees already charged for a subscription period are generally non-refundable, except where applicable mandatory law requires otherwise.
8. Acceptable use
You agree to use MarginNav lawfully and not to attempt unauthorized access to or interference with the service, attempt to compromise its security, or misuse another person's account.
9. Availability and changes
We aim to keep MarginNav available and reliable, but the service may occasionally be unavailable for maintenance, security work, or reasons outside our control, and we do not guarantee uninterrupted or error-free service. We may improve or make reasonable changes to MarginNav over time, but we will not arbitrarily remove core functionality you are paying for without reasonable notice.
10. Financial decision-support disclaimer
MarginNav's calculations are based entirely on the information you enter. We do not independently verify the accuracy or completeness of your menu, ingredient prices, recipes or sales entries, and you are responsible for the accuracy of the data you provide. MarginNav provides decision-support information, not professional accounting, tax or legal advice, and any business decisions you make based on MarginNav remain your own responsibility.
11. Suspension and termination
We may restrict or suspend access to MarginNav for a subscription that is not active or trialing, including where a payment attempt fails. We may also suspend or terminate access in cases of unlawful use or serious misuse of the service. You may stop using MarginNav and end your subscription at any time as described in Section 6.
12. Liability
To the extent permitted by applicable law, Dudás Digital Studio's liability for damages arising from your use of MarginNav is limited to the subscription fees you paid in the twelve months preceding the event giving rise to the claim. This limitation does not apply to liability for intent or gross negligence, or to any liability that cannot be limited or excluded under applicable law.
13. Governing law
These Terms are governed by Swiss law. Any dispute arising from these Terms or your use of MarginNav is subject to the jurisdiction of the courts of Lugano, Switzerland, without prejudice to any mandatory jurisdiction or consumer-protection rights you may have under applicable law that cannot be excluded by these Terms.
